The Owner acknowledges and agrees to the following terms regarding the spaying or neutering of the puppy purchased from Ohana Great Danes of Michigan ("Breeder"):
Age Restriction for Spay/Neuter:
The Owner agrees not to spay or neuter the puppy before it reaches the age of 18 months for males and 24 + months for females unless explicit written approval is obtained from the Breeder. Such approval must be granted through the Breeder's official Spay/Neuter Release Form.
Breeder Approval:
Any decision to spay or neuter the puppy prior to the age of 18 months without prior approval from the Breeder may result in a breach of this agreement. The Breeder reserves the right to take any necessary legal actions to enforce this clause.
Health Considerations:
This age restriction is in place to ensure the proper physical development and health of the puppy, as premature spaying or neutering can have significant health impacts on Great Danes.
Legal and Medical Expense Responsibility:
Should legal or medical intervention be necessary due to the Owner’s breach of this agreement, the Owner will be responsible for covering all related costs incurred by the Breeder, including but not limited to legal fees, attorney costs, and veterinary expenses related to the enforcement of this clause.
Compliance:
The Owner must comply fully with this agreement as part of their overall commitment to the health and well-being of the puppy. Failure to adhere to this clause may result in consequences deemed appropriate by the Breeder, including but not limited to legal action.
Removal and Penalty Fee:
If the Owner breaches this agreement, the Breeder reserves the right to reclaim the dog. Additionally, a penalty fee equal to 1.5 times the original purchase price of the dog will be imposed. This fee is due within 7 business days of the Breeder's notification of the breach.
If the penalty fee is not paid within 7 business days, an additional interest of 15% per day will be added to the outstanding balance until the full amount is paid.
Agreement Binding:
This agreement is legally binding upon signature by the Applicant/Buyer. Any breach of this agreement will be subject to legal enforcement and penalties as described herein.
Any disputes arising from this agreement shall be resolved through mediation or, failing that, through binding arbitration in the jurisdiction where Ohana Great Danes of Michigan is located.
